CRITICAL DISCOURSE ANALYSIS OF COURT DECISIONS ON SEXUAL HARASSMENT
Research abstract

The goal of this research is to undertake a critical analysis of the discourse of court decisions to highlight possible discriminatory discursive trends in institutional responses to the judicialization of sexual harassment. My assumptions are that legal discursive practice is a space of clashes whose meaning is engendered in an ideologically oriented way and that it must be analyzed based on its connection with social circumstances. I work with the hypothesis that discourses spread by the justice system can contribute to the trivialization of cases of sexual harassment against women and to the perpetuation of stereotypes, prejudices and discrimination based on gender. Methodologically, it is a documentary and bibliographical research with a qualitative profile guided by the contribution of feminist theories on Law. I opted for a critical analysis of the discourse of court decisions because they favor the description of institutional practices, world views and power relations. This research rejects the androcentric values and totalizing premises of modern scientific thought without retreating into relativism.
