The objective of this research is to undertake a critical analysis of the discourse of judicial decisions in order to identify possible discriminatory discursive tendencies in institutional responses to the judicialization of sexual harassment. I wish to highlight the ways in which the asymmetry of gender relations is made invisible or reinforced through institutional discourses and to denounce stereotypical and stigmatizing representations of victims. I start from the assumption that legal discursive practice is a space of conflicts whose meaning is generated in an ideologically oriented way, and should be analyzed based on its connection with social circumstances. I work with the hypothesis that discourses aired by the justice system can contribute to the trivialization of cases of sexual harassment and to the perpetuation of stereotypes, prejudices and discrimination based on gender. With the support of the works of Catharine MacKinnon (1979, 1987, 1991), Judith Butler (2013) and Patricia Hill Collins (2019), I intend to verify my hypothesis, giving this research the gender perspective that is so pertinent to it.
